Please review the contract below carefully. It is non-exclusive, meaning you retain all rights to your song. By submitting your track, you confirm that you own the rights to the music and grant us permission to feature it in an episode. In exchange, you agree to forgo any monetary compensation, including royalties, for the use of your song(s) in the podcast. We will make every effort to provide listeners with information that will help them discover, follow, and add your music to their playlists.

AGREEMENT BETWEEN MUSIC ARTIST AND mysoundMusic PODCASTER

This Agreement (the “Agreement”) is made and entered into as of the date last signed below, by and between:

1. Grant of Rights

The Artist hereby grants to the Podcaster a non-exclusive, royalty-free, worldwide license to use, feature the songs listed below (the “Songs”) in one or more episodes of the mysoundMusic Podcast (the “Podcast”). This license allows the Podcaster to incorporate the Songs in its Podcast episodes, which may be distributed, broadcast, or streamed through various platforms, including but not limited to online streaming services, podcasts, websites, and social media channels.

2. Compensation

The Artist agrees that they will not receive any monetary compensation, including royalties, for the use of the Songs in the Podcast. The only compensation provided to the Artist under this Agreement is the promotion of their music through the Podcast and related promotional activities.

3. Promotion

To promote the Artist and their music, the Podcaster agrees to include the following in connection with each episode featuring the Songs:

• Links to the Artist’s official music platform(s), such as Spotify, Apple Music, or other similar platforms, for listeners to access and enjoy the Artist’s full catalog of music.
• A brief mention of the Artist’s name and a short bio or description during the Podcast episode.
• Other reasonable promotional activities at the discretion of the Podcaster, such as social media posts or mentions on mysoundMusic’s website.

4. Ownership and Control

The Artist acknowledges and agrees that the Podcaster retains full control and ownership of the Podcast, including all rights to the content, format, and distribution of the Podcast. The Artist further acknowledges that this Agreement does not transfer any ownership rights in the Songs to the Podcaster.

5. No Other Rights

Except for the rights expressly granted in this Agreement, the Artist retains all rights, title, and interest in the Songs, including but not limited to the copyright in the music, lyrics, and sound recordings. This Agreement does not grant the Podcaster any rights to use the Songs for any purposes outside of the Podcast or its associated promotional activities.

6. Duration of Agreement

This Agreement shall be effective as of the date signed below and will remain in effect for as long as the Podcast episodes containing the Songs are publicly available, unless terminated earlier by mutual written consent of both parties.

7. Termination

Either party may terminate this Agreement with thirty (30) days’ written notice to the other party. Upon termination, the Podcaster agrees to cease using the Songs in future Podcast episodes, though any previously published episodes featuring the Songs may remain accessible as part of the Podcast’s archive.

8. Indemnification

The Artist agrees to indemnify and hold harmless the Podcaster, its affiliates, and agents from any claims, damages, losses, or liabilities arising from the Artist’s breach of this Agreement or the use of the Songs, including any third-party claims of infringement of rights in the Songs.

9. Miscellaneous

• This Agreement constitutes the entire understanding between the parties regarding the subject matter and supersedes all prior discussions, negotiations, or agreements, whether written or oral.
• Any amendments or modifications to this Agreement must be in writing and signed by both parties.
• This Agreement shall be governed by and construed in accordance with the laws of the state or country in which the Podcaster operates.
• If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
